Here is the translation of the General Terms and Conditions (AGB) into English.

General Terms and Conditions (GTC)

1. Scope of Application

These General Terms and Conditions (GTC) apply to all orders, contracts, and services concluded via the domains bondair.one, mybondo.com, and bondomilano.com. The contractual partners are Bondos GmbH, 7000 Chur (Switzerland), and Bondo Inh. Bonderer. The GTC apply to private customers (B2C) and business customers (B2B). Deviating conditions of the customer shall not apply unless they have been confirmed in writing.

2. Products, Information, and Availability

All information regarding products, fragrance compositions, technical specifications, delivery times, and prices is provided without guarantee. Images are for illustrative purposes. Deviations may occur due to supply shortages or production changes. Bondos GmbH & Bondo reserve the right to modify or discontinue products at any time.

3. Ordering and Conclusion of Contract

An order constitutes a binding offer by the customer. The contract is only concluded upon written acceptance or dispatch of the products. Bondos GmbH & Bondo may reject orders without stating reasons (e.g., creditworthiness issues, implausible quantities, commercial resale without a contract).

4. Prices and Payment Terms

All prices are stated in CHF incl. VAT. Shipping costs are shown separately. The customer undertakes to pay using the payment methods offered in the shop. Late payment entitles Bondos GmbH & Bondo to suspend deliveries or terminate contracts.

5. Delivery and Transfer of Risk

Deliveries are made to addresses in Switzerland and Liechtenstein. Risk transfers to the customer or the transport company upon handover. Transport damage must be reported immediately. Delays in delivery do not entitle the customer to claims for damages.

6. Use of Aroma Oils and Devices – Safety & Liability Disclaimer

Aroma oils and concentrates must be handled with particular caution; they must not be ingested, applied undiluted to the skin, or kept within reach of children or pets. Any guarantee, warranty, and liability claims are completely voided if fragrances, oils, or aromatic substances that do not originate from Bondo or BondoMilano are used in devices (aroma diffusers, hotel scent devices, mobile devices, travel devices). This specifically includes:

Damage to the device (technical, electrical, mechanical)
Health complaints resulting from unauthorized or improper use
Impairment of rooms, surfaces, or materials
Any direct or indirect consequential damages

The customer is obliged to carefully observe the safety and application instructions.

7. Warranty and Guarantee

The statutory provisions according to Art. 197 et seq. of the Swiss Code of Obligations (OR) apply. There is no right to a replacement delivery; rectification (repair) takes priority. Excluded are:

Wear and tear resulting from use
Damage caused by improper use
Damage caused by third-party oils (see Section 6)
Modifications or interventions on the device Test models or demonstrated devices may show signs of use; no warranty claims arise from this.

8. Limitation of Liability

Bondos GmbH & Bondo are liable exclusively for damages caused by intentional or grossly negligent behavior. Liability is excluded for:

Indirect damages
Secondary damages
Lost profits
Production downtime
Consequential damages resulting from scent marketing or aroma applications
Damages caused by operating errors, foreign substances, or unauthorized modifications B2B customers acknowledge that fragrance effects are subjective and that no guarantee of success or effect exists.

9. Returns and Revocation

For B2C (private customers), a return period of 10 days from the invoice date applies. Returns must be unused, unopened, and in the original packaging. For B2B customers, there is no right of return unless agreed upon in writing. Defective products must be reported immediately; in the case of defective goods, an equivalent replacement or repair will be provided after inspection.

10. Data Protection

The currently valid Privacy Policy applies, which is an integral part of these GTC. Customer data is used exclusively for contract fulfillment and is not passed on to unauthorized third parties.
